1. Acceptance of Terms

By accessing or using any services, software, or products provided by PixelCollab ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our services.

2. Services Provided

PixelCollab provides business automation, AI integration, workflow optimization, and related consulting services. Services may include but are not limited to software development, AI agent deployment, system integration, and ongoing support. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are accessing our services on behalf of a company, you represent that you have the authority to bind that company to these Terms.

4. Accounts and Security

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you suspect unauthorized access, you must notify us immediately at hello@pixelcollab.co.

5. Payment and Fees

All services are billed according to the terms agreed upon in your project proposal, subscription, or service agreement. Payments must be made in the currency specified on the invoice. Late payments may incur a 5% monthly interest or suspension of service. Fees are non-refundable unless otherwise stated in writing.

6. Intellectual Property

All intellectual property rights related to PixelCollab's software, designs, algorithms, or documentation remain the sole property of PixelCollab unless otherwise agreed in a written contract. Clients retain ownership of their data and proprietary materials provided for use in a project. You may not copy, distribute, modify, or reverse-engineer any part of our software or intellectual assets.

7. Confidentiality

Both parties agree to keep confidential information private and not disclose it to any third party without prior written consent, except where required by law.

8. Limitation of Liability

To the fullest extent permitted by law, PixelCollab shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities arising from the use or inability to use our services. Our total liability in any circumstance shall not exceed the total amount paid by the client in the past 3 months for the service in question.

9. Warranties and Disclaimers

Our services are provided "as is" and "as available." We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We may suspend or terminate your access to our services at any time, with or without cause, if we believe you have violated these Terms. Upon termination, all outstanding payments become immediately due.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict-of-law principles.

12. Dispute Resolution

Any disputes arising under these Terms will be resolved through arbitration in Singapore, under the rules of the Singapore International Arbitration Centre (SIAC). The arbitration shall be conducted in English.

13. Changes to Terms

We may revise these Terms at any time. Updates will be posted on our website, and continued use of our services after such changes constitutes acceptance.
